Privacy Policy

1. This short document sets forth the On-Track Aviation Online Privacy Policy (the "Privacy Policy") for this Web site: www.ontrackaviation.com (the "Site"). If you have any objections to the Privacy Policy, you should not access or use this Site.

2. As a visitor to this Site, you can engage in activities without providing any personal information. On-Track Aviation may ask you to provide certain information about yourself by filling out and submitting an online form. It is completely optional for you to engage in these activities. If you elect to engage in these activities, however, On-Track Aviation may ask that you provide us personal information, such as your first and last name, mailing address (including postcode), e-mail address, telephone and facsimile numbers, and other personal information.

3. When you use the Site, On-Track Aviation or third parties authorized by On-Track Aviation may also collect certain technical and routing information about your computer to facilitate your use of the Site and its services. For example, we may log environmental variables, such as browser type, operating system, CPU speed, and the Internet Protocol ("IP") address of your computer. We use these environmental variables to facilitate and track your use of the Site and its services. On-Track Aviation also uses such environmental variables to measure traffic patterns on the Site. Without expressly informing you in each particular circumstance, we do not match such information with any of your personal information.

4. On-Track Aviation will not provide your name or any of the personal/technical information gathered to other companies or organizations without your consent.

No Show Policy

1. The following No Show Policy shall remain in force until it is amended by On-Track Aviation Limited. For the pupose of this No Show Policy “the provider” is On-Track Aviation Limited and “the learner” is the candidate undergoing training, ground examination or flight test.

2. It is the On-Track Aviation Limited policy to charge candidates who book courses of training, ground examinations or flight tests with On-Track Aviation Limited or its examiners and fail to turn up with out having contacted On-Track Aviation Limited or the instructor / examiner in the previous 24 hours prior to starting the course of training, ground examination or flight test.

3. The acceptable means of contact includes telephone, email or fax. If candidates leave a voice message they MUST, IN ADDITION, back this up with an email or fax to On-Track Aviation Limited or the instructor / examiner directly concerned.

4. Failure to comply with paragraph 3 of this policy will incurr a no-show charge. The no show charge shall be half the course of training, ground examination or flight test fee at the prevailing rates.

Terms and Conditions of Acceptance for Training

1. The following Terms and Conditions of Acceptance for Training shall remain in force until they are amended by On-Track Aviation Limited. For the pupose of these Terms and Conditions of Acceptance of Training “the provider” is On-Track Aviation Limited and “the learner” is the candidate undergoing training, ground examination or flight test.

2. All courses are offered for the dates and times set out in the On-Track Aviation Limited literature or proposal issued, subject to demand and to places remaining available.

3. Acceptance of a candidate on a scheduled course does not automatically signify acceptance for subsequent ground or flight training courses. An agreed deposit must be paid to reserve a place on each course.

4. A deposit of £200 reserves a place on any On-Track Aviation Limited course and is non-refundable. However, it is credited to the course fee on commencement.

5. The agreed installment of course fees is payable on course commencement and there after at the time / date agreed unless otherwise confirmed in writing. If a payment by instalment is agreed, should any fees remain unpaid after the time / date on which they fall due whether demanded or not, the company will be entitled to terminate the candidate's training immediately and remove any discounts. All fees remaining unpaid will accrue interest at a rate of 2% above the LloydsTSB Bank lending rate.

6. Payments may be made by Credit / Debit Card, Pounds Sterling in cash, by cheque with a valid Bankers Card, or by BACS. If payment is made by Eurocheque or overseas Bank Draft, On-Track Aviation Limited reserves the right to recharge any bank charges and exchange rate variations to the candidate. If payment is received in foreign currency a 5% handling charge will be levied in addition to bank charges.

7. All prices will be quoted/charged inclusive of VAT where applicable. In the event of increases in the cost of fuel, landing fees or CAA fees, On-Track Aviation Limited reserves the right to levy a supplementary charge equivalent pro rata to the hourly charges for the anticipated flying hours remaining.

8. All costs and course fees are correct at the date of current On-Track Aviation Limited literature, but may be subject to change at short notice. On-Track Aviation Limited reserves the right to withdraw any published courses prior to commencement.

9. On-Track Aviation Limited reserves the right to charge a “no-show” or late cancellation charge where appropriate in accordance with the No-Show Policy.

10. Any training required in excess of the minimum hours in each course will be charged at the then current prevailing rate. Any additional attempts at ground examinations and flight tests will be charged at the prevailing rates.

11. Upon termination of a candidate's training by On-Track Aviation Limited or the candidate, for whatever reason, the balance of all outstanding fees for training in respect of that candidate shall immediately become due and payable. The balance of any money held in credit to be refunded by On-Track Aviation Limited subject to an administration charge of £20.

12. On-Track Aviation Limited will create and maintain records of the candidate's training, which will be kept for the period required by the Civil Aviation Authority or other regulatory body, and will be available to authorised persons for inspection. Such records will also be available for the candidate's perusal and, where appropriate, written comment.

13. Candidate’s must conduct themselves in a disciplined manner at all times and obey the rules and regulations of On-Track Aviation Limited, and the instructions of its management and instructors; make themselves familiar with, and comply with the Airfield Manual and On-Track Aviation Limited Combined Operations and Training Manual. Punctuality must be maintained, and any studies missed through absence must be made good by the candidate in his/her own time through private study. Non-attendance for whatever reason may result in delay or disruption and On-Track Aviation Limited can accept no responsibility for this. On-Track Aviation Limited reserves the right to terminate a candidates's training for failure to comply with the provisions of this paragraph.

14. On-Track Aviation Limited also reserves the right to terminate a candidate's training for failure to achieve an adequate standard, or for any other reason connected with the candidate's performance.

15. All flight and ground training is subject to the health and ability of the pilot, suitable weather and the availability of instructors and aircraft. Acceptance by On-Track Aviation Limited of a candidate for a course of training does not imply that the candidate is assured of passing the appropriate examinations or flight tests. Neither does it imply the candidate's suitability for employment as a pilot following a successful completion of training and testing. An instructor's recommendation or certification that a candidate has reached the required standard to take an examination or flight test does not guarantee that the candidate will pass the examination or flight test.

Equal Opportunities and Diversity Policy

1. On-Track Aviation Limited is totally opposed to discrimination in any form and is committed to taking action to counter such discrimination. Consequently no candidates will be treated unfavourably on the grounds of colour, ethnic or national origin, gender, creed, disabilities, marital status, sexual orientation and identity, age or irrelevant convictions.

2. All candidates will be recorded on the basis of age, ethnic origin, gender and disability (where appropriate) at the time of registration; all information will be recorded and monitored. The objective is to ensure that there are equal opportunities for all candidates to take advantage of training.

3. Where a candidates disability might be overcome by special measures (e.g. for someone who is in a wheelchair assistance to/from the aeroplane will be provided) all assistance will be made availably to the best of our ability.

4. Overall responsibility for this policy lies with the Directors and implementation will rest with any nominated person, every staff member of On-Track Aviation Limited has a responsibility for carrying out the policy within his or her area of work and influence.

5. Candidates will receive notice of the above prior to starting a course of training, candidates will be assured staff are available to assist with related issues, and at all times such issues will be dealt with in a confidential and professional manner.

Refunds Policy

1. Effective date

1.1 This policy is effective from 1st January 2006 and will remain in force until amended.

2. Students transferring to another FTO

2.1 When a student transfers to another FTO, any training or part thereof undertaken up to and including the date of transfer must be paid for by the student in full to On-Track Aviation Limited.

2.2 Any part of a tuition fee already paid which after any deductions exceeds the amount required by paragraph 2.1 above will be refunded in full.

2.3 If a student requests a copy of their training file a charge will be levied to cover the cost of administration.

3. Students withdrawing from training

3.1 All other student's withdrawing from On-Track Aviation Limited courses, whether transferring to another FTO or not, are subject to the tuition fee refund provisions set out below.

3.2 If a student withdraws before the start of the course and has not completed any pre-entry examination or flight test/check, then they are entitled to a full refund of the course fee.

3.3 If a student withdraws after the start of the course and has undergone either ground or flight training including any pre-entry examination or flight test/check, then they are entitled to a refund of the tuition fees less the amount covering payment for the ground or flight training including any pre-entry examination or flight test/check already received or undertaken.

3.4 Determining the precise date of withdrawal can be difficult, but it should be the date upon which formal (i.e. written) notice of withdrawal is received and not the point at which the student ceases attendance.

3.5 If a student requests a copy of their training file a charge will be levied to cover the cost of administration.

4. Students undergoing examination

4.1 Students under going examinations (i.e. ground or flight examinations) shall not be entitled to a refund if the examination is failed.

4.2 If the student feels that the examination was conducted in an inappropriate manner they shall inform the examiner immediately on completion of the examination. If the student considers that the examiner's explanation still does not resolve the matter, then the Head of Training is to be informed in writing, as soon as possible. The Head of Training, after due consideration of all the facts of the case, will make a final and bidding decision:

a) Sustains the student's complaint - may award one further attempt at the examination free of charge.

b) Over rules the student's complaint - no further action.

5. Seminar registration cancellation and transfers

5.1 Registration may be cancelled up to 14 working days before the seminar. Any fee paid will be refunded less an administration charge of £20. Cancellation less than 14 working days before the seminar no refund will be given.

5.2 Alternatively, and with the agreement of a Director of On-Track Aviation, delegates may send a substitute or transfer their registration to another On-Track Aviation seminar venue.

5.3 Transfer at any time to another venue may incur additional administration charges.

6. Exceptions

6.1 There will be no exceptions to this policy other than in the most extreme of circumstances and then only with the prior written consent of a Director of On-Track Aviation Limited.

Health and Safety Policy Statement

Our statement is:
1. To provide adequate control of the health and safety risks arising from our work activities;
2. To consult with our employees on matters affecting their health and safety;
3. To provide and maintain safe plant and equipment;
4. To ensure safe handling and use of substances;
5. To provide information, instruction and supervision for employees;
6. To ensure all employees are competent to do their tasks, and to give them adequate training;
7. To prevent accidents and cases of work-related ill health;
8. To maintain safe and healthy working conditions;
9. To review and revise this policy as necessary at regular intervals.
